Burpee Bounce Back – terms and conditions

All participants agree to the following waiver:

I choose to participate in Orygen’s Burpee Bounce Back Challenge in 2022. I acknowledge that my participation in all activities associated with the Burpee Bounce Back Challenge is voluntary, and that I alone am responsible for my health and safety.

By signing up, I hereby represent to Orygen and to its directors, officers, agents and employees that:

1. I have full legal authority to complete this registration.
2. While participating in this challenge may have health benefits, I understand that Orygen provides no warranty whatsoever that this challenge will achieve my health goals. I understand that the Burpee Bounce Back Challenge has not been developed with my or any individual's particular health requirements in consideration.
3. I understand that participation in the Burpee Bounce Back Challenge may involve risk as there are risks specifically associated with participation in the recreational activity and accidents can and do occur which may result in personal injury or death. Prior to undertaking any such activity, I understand that I must ensure that I am are aware of all the risks involved, including those risks associated with any health condition I may have. 
4. I hereby assume full responsibility for any and all risks to my person pursuant to such participation and hereby irrevocably and unconditionally release and discharge the Event Parties from any liability and hereby irrevocably and unconditionally waive and agree not to bring or permit to be brought, any claim, action or application against the Event Parties as a result of any injury I may suffer or incur in connection with my participation in the Burpee Bounce Back Challenge.
5. My donations received are non-refundable or transferable once paid.
6. I understand that my contact details will be used to keep me informed about Burpee Bounce Back Challenge, and to keep me up to date on the work of Orygen. I can opt out of communication at any stage.
7. I agree that the information I have provided on this registration form, along with the personal story and image I post publicly on my Burpee Bounce Back Challenge fundraising page may be shared with and used by Orygen for the purpose of helping to further its mission. I understand that my name, email and other personal information from my registration form will be used and shared by Orygen in order to effect my registration in the Burpee Bounce Back Challenge.
8. I acknowledge that my name, image and fundraising total may be publicly shared for the purposes of publicly acknowledging my contribution to Orygen’s work, or for the purpose of helping to further the mission of Orygen.
9. I consent to the collection, use and/or disclosure of my personal information by Orygen for the conduct, planning, organisation, administration, management, promotion or execution of the Burpee Bounce Back Challenge, including to third parties, for related purposes in connection with my participation in or registration for the Burpee Bounce Back Challenge, for the offering of products and services related or relevant to the Burpee Bounce Back Challenge to me, for compliance with applicable laws and regulations and for the performance of Orygen of activities relating to its internal compliance requirements. I acknowledge that in the course of such collection, use and/or disclosure, relevant personal information may be transferred outside of Australia.
10. I agree that the use by Orygen of any personal information I have provided on this registration form will be governed by applicable law and the privacy policies of the entities concerned. I understand that the Privacy Policy for Orygen is available from Orygen upon request and I may contact Orygen for further information regarding any other party’s privacy policy.

Having read and agreed to the conditions of participation as contained within this registration form, and knowing the truthfulness of the information that I have disclosed on this form, in consideration of the acceptance of this application, to the maximum extent permitted by law, I, for myself and for anyone for whom I am legally entitled to act, waive and release Orygen (as well as suppliers of the challenge including but not exclusive to Made With Ed Pty Ltd t/as Funraisin) the directors, employees and representatives of them, from any claims or liabilities of any kind arising in connection with my participation in the Burpee Bounce Back Challenge even though such claims or liabilities may arise out of negligence of any such party. I agree to indemnify and keep indemnified the Event Parties and all of their officers, directors, employees, agents, representatives, successors and assigns, and each of them jointly and severally, of and from against all actions, suits, demands, claims, proceedings, costs, expenses (including reasonable solicitors’ fees), liabilities and judgements whatsoever (including without limitation for negligence, breach of contract and/or breach of statute) arising out of, in connection with, or in relation to my participation in the Burpee Bounce Back Challenge and/or my commencement of any action, suit or proceeding now or in the future with respect to any matters waived, released or consented to under this waiver, including without limitation any claims for invasion of privacy or publicity or unintentional errors occurring in such use and publication.
